These Terms of Service ("Terms") govern your use of the Tattoo Agent platform operated at tattooagent.art (the "Platform"). By creating an account or using our services, you agree to these Terms. If you do not agree, do not use the Platform.

These terms are provided as a general guide and do not constitute legal advice. We recommend consulting with a legal professional for compliance with your specific jurisdiction.

1. Account Creation and Responsibilities

• You must be at least 18 years old to create an account.
• You are responsible for maintaining the security of your account credentials.
• You are responsible for all activity that occurs under your account.
• You must provide accurate and complete information during registration.
• You may not share your account with others or create multiple accounts.

2. Subscription and Pricing

• Setup fee: a one-time payment of $250 is charged at the time of subscription for AI-assisted onboarding and initial website setup.
• Monthly subscription: $99 per month, billed automatically on a recurring basis.
• Prices are in US dollars and are subject to change with 30 days' notice.

3. Payment and Billing

• All payments are processed securely through Stripe. We do not store your credit card information directly.
• Your subscription renews automatically each billing cycle until cancelled.
• You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period — no partial refunds are issued for unused time.
• We offer a 30-day money-back guarantee from the date of your initial subscription. Contact us to request a refund within this period.
• If payment fails, we will attempt to charge your payment method again. After repeated failures, your account may be suspended.

4. Usage-Based Billing

In addition to the monthly subscription, certain services are billed based on usage:

• AI processing: conversations with the AI assistant consume tokens, billed at 2x our underlying cost.
• Email sending: transactional and marketing emails are billed at 2x our email delivery cost.
• SMS messages: text messages sent and received are billed at 2x our SMS provider cost.

Usage charges are included in your monthly invoice. Typical usage for most businesses is approximately $10–$20 per month.

5. Acceptable Use

You agree not to:

• Use the Platform for any illegal purpose or to violate any laws
• Send spam, unsolicited messages, or bulk communications without recipient consent
• Upload content that is illegal, harmful, threatening, abusive, defamatory, or otherwise objectionable
• Attempt to access other users' accounts or data
• Reverse engineer, decompile, or disassemble any part of the Platform
• Use the Platform to compete with or replicate our services
• Abuse the AI system by attempting to generate harmful, illegal, or misleading content

6. Account Termination

• You may close your account at any time by contacting us.
• We reserve the right to suspend or terminate accounts that violate these Terms or our acceptable use policy.
• Upon termination, your business website will be taken offline. Your data will be retained for 90 days and then permanently deleted (see our Privacy Policy for details).

7. Intellectual Property

• Your content: you retain full ownership of all content you upload or create on the Platform, including images, text, designs, and business data.
• License to us: by using the Platform, you grant us a limited, non-exclusive license to host, display, and transmit your content solely for the purpose of providing our services (e.g., displaying your website to visitors, sending emails on your behalf).
• Our platform: the Tattoo Agent platform, including its code, design, and branding, is our intellectual property. You may not copy, modify, or distribute it.
• AI-generated content: content generated by the AI assistant (bios, email copy, FAQs, etc.) is provided for your use and becomes part of your business content once you accept it.

8. AI-Generated Content Disclaimer

The Platform uses artificial intelligence (powered by Anthropic's Claude) to assist with content creation, business management, and client communication. You acknowledge that:

• AI-generated content may contain errors, inaccuracies, or inappropriate suggestions.
• You are responsible for reviewing and approving all AI-generated content before it is published or sent to clients.
• The AI does not provide legal, medical, or financial advice.
• We are not liable for any consequences of AI-generated content that you choose to publish or send.

9. Limitation of Liability

To the maximum extent permitted by law:

• The Platform is provided "as is" and "as available" without warranties of any kind, either express or implied.
• We do not guarantee that the Platform will be uninterrupted, error-free, or secure.
• Our total liability for any claim arising from your use of the Platform is limited to the amount you paid us in the 12 months preceding the claim.
• We are not liable for indirect, incidental, consequential, or punitive damages, including lost profits or lost data.

10. Dispute Resolution

If a dispute arises between you and Tattoo Agent:

• If informal resolution fails, disputes will be resolved through binding arbitration in accordance with applicable arbitration rules.
• These Terms are governed by the laws of the United States.

11. Modification of Terms

We may modify these Terms at any time. If we make material changes, we will notify you by email at least 30 days before the changes take effect. Your continued use of the Platform after the effective date constitutes acceptance of the modified Terms. If you do not agree with the changes, you may cancel your subscription before they take effect.
